On 25/02/12, I was travelling back to NZ from our family holiday in Gold Coast, Australia. I was stopped by customs in Brisbane and told that my residency permit has expired. It was an unpleasant surprise as my husband rang INZ prior to our trip and was told that we do not have to do anything. Australian customs spoke to INZ who allowed me to travel. Upon returning to NZ, the Immigration officer at Chch airport told me system has changed a lot as per new 2009 Immigration act people who hold ‘residence visas’, ‘residence permits’ and ‘non indefinite RRVs’ on 29 November 2010 are automatically deemed to hold ‘resident visas’ with the appropriate travel conditions but as my RRV expired on 6/08/2010 I needed to apply for a new Permanent Residency visa or some travel conditions visa prior to my trip.
I was issued with the temporary permit (expiry date 25/03/2012) and given the form to apply for a new visa. It was not a big drama at this stage it seemed, nobody mentioned to me at any stage that I am under temporary VISITOR permit and not allowed to work. Also I have never received in mail or email any information about my temporary visa conditions so I carried on as usual.
On 5/03/21012 I sent my application for a new Permanent Resident Visa to Christchurch branch and my credit card was charged for application fee of $160 on 06/03/2012.
On 19/03/2012 around 5 pm I rang INZ customer service to check how my application was going as my temporary permit was due to expire by the end of this week . At some point in our phone conversation I was told that I am actually not allowed to work at all as I am under visitor permit. So I have notified my employer on the same day and went to Christchurch branch first thing next morning on 20/03/2012.
Receptionist looked at my file and told me that I can work, so I went home ready to go back to work but my employer needed something in writing in regards to my rights to work . So I rang INZ customer service again and was told by officer Tania that I am not allowed to work, she also checked with Chch branch again and confirmed it. So I went back to Chch branch and asked for something in writing to provide to my employer.(Дали дурацкую бумажку где написано что я подала на резу и на виэитерке сейчас.)
Also I asked how long it would take to process my application as my temporary permit expiry date 25/03/2012 which is Sunday and was told that it is soon and my case is not urgent.
I went to work and asked my manager for alternative holiday as I do not have right to work.
I am a Liquor Manager at Countdown, my department one of the biggest sales wise in the South Island. My work is very important to me and to my employer as we are leading into Easter preparation which starts 19/03/2012 which I have now missed.
I have lived in Christchurch since 2006, own a house, married to NZ citizen and mother of another NZ citizen. I have rang INZ that day again with intention to lodge a complaint and the best what I got out from INZ Customer service the name and email of my case manager ______ , which I have emailed 20/03/2012 at 4.40 pm explaining why I need my application to be processed urgently. Still have not heard back.
I am very disappointed because the service provided by INZ was defective with no consistent answers and actions. INZ never informed me about the expiry of my RRV or notified about change of Immigration Act 2009. I believe INZ should ( see attached emails -reminders) and has the ability to provide some kind of reminder service especially in regard to conditions and changes to the main policy. I think it was unnecessary for me to stay away from work and it should be a priority to process my application.
