EXPRESSION OF INTEREST: DECLINED
Dear Mr
I regret to advise that I am unable to invite you to apply for residence in New Zealand at this time.
While checking the details you provided in your Expression of Interest I determined that the following claims were made in error:
You have claimed 10 bonus points for your qualification being in an Area of Absolute Skill Shortage (AASS); however, I am not willing to award these points as I am not satisfied you meet the requirements set out in SM16.20 below:
SM16.20 Qualifications in an area of absolute skills shortage
If a principal applicant does not have skilled employment in New Zealand in an area of absolute skills shortage (see SM8.20 ), they will be assessed as being qualified in an area of absolute skills shortage if they meet the specifications in Column 4 of the Long Term Skill Shortage List (see Appendix 4 ) or that was listed on the date their Expression of Interest was selected.
If a principal applicant does have skilled employment in New Zealand in an area of absolute skills shortage (see SM8.20) their recognised qualification will be assessed as being in an area of absolute skills shortage if the specialist, technical or managerial expertise required for that employment was obtained through the completion of that qualification.
Recognised qualifications in an area of absolute skills shortage only qualify for points if any occupational registration requirements relating to those qualifications are met (see SM19.15 )
I am not satisfied you meet this policy for the following reasons:
· You have claimed points for the following qualification:
· Specialist Diploma majoring in Organization and Technology of Information Protection
· You have listed your AASS as Electronics Engineer (Design Engineer - Electronics/Product Engineer) (233411)
1 The Long Term Skill Shortage List (LTSSL) states in order to claim these bonus points you must have a Bachelor Degree (Level 7) qualification majoring in electronics, computer science or telecommunications
2 You do not appear to hold a Bachelor Degree (Level 7) qualification majoring in electronics, computer science or telecommunications
3 A Specialist diploma (level 8) is not comparable to a Bachelor degree (level 7) qualification
For these reasons I cannot award you with the 10 bonus points claimed for qualifications.
You have claimed 15 points for your recognised work experience, however I am not willing to award these points as I am not satisfied you meet the requirements set out in SM11.10 below:
SM11.10 Requirements for recognition
Work experience is recognised and qualifies for points if it meets the requirements set out at (a) and (b) below:
a. An immigration officer must be satisfied that work experience is:
i. relevant to the principal applicant's current skilled employment in New Zealand or offer of skilled employment in New Zealand (see SM7); or
ii. relevant to the principal applicant's recognised qualification (see SM14); or
iii. skilled, because it required, or enabled the principal applicant to gain specialist, technical or management skills and experience relevant to an occupation that is included in the lists of occupations held at Appendix 6 or Appendix 7.
b. Work experience must also have been gained in a labour market that is comparable to the New Zealand labour market unless:
i. the work experience meets the requirements set out at SM13.20 for work experience in an area of absolute skills shortage; or
ii. the principal applicant has current skilled employment in New Zealand or an offer of skilled employment in New Zealand (see SM7).
SM11.10.1 Definition: Comparable labour market
a. Work experience is assessed as being in a comparable labour market if it was undertaken in one of the following countries by:
i. a citizen or permanent resident of that country; or
ii. a person who had the lawful authority to work in that country.

Work experience undertaken in a country not listed at (a) above will be assessed as being in a comparable labour market only if it was undertaken for a multinational commercial entity (including a wholly or majority owned subsidiary of such an entity that bears the same core name as the parent company) domiciled in one of the countries listed in (a) above.
I am not satisfied you meet this policy for the following reason:
Russia is not on the list of comparable labour market countries
For this reason I cannot award you with the 15 points claimed for work experience.
You have claimed 10 bonus points for your work experience being in an Area of Absolute Skill Shortage (AASS); however, I am not willing to award these points as I am not satisfied you meet the requirements set out in SM13.20 below:
SM13.20 Work experience in an area of absolute skills shortage
a. Recognised work experience is assessed as being in an area of absolute skills shortage if:
i. it was undertaken in an occupation included on the Long Term Skill Shortage List (refer Appendix 4) or that was on the Long Term Skill Shortage List at the time their Expression of Interest was selected; and
ii. it meets the specifications for that occupation; and
iii. the principal applicant is suitably qualified by training and/or experience to undertake that work (including any specific requirements set out in column 3 of the Long Term Skill Shortage List or that were listed on the date their Expression of Interest was selected).
b. Where the Long Term Skill Shortage List specifies that occupational registration is required for a listed occupation, principal applicants must demonstrate that they held occupational registration while undertaking the work experience, if occupational registration is required in the country in which the work occurred.
I am not satisfied you meet this policy for the following reasons:
You have listed your AASS as Electronics Engineer (Design Engineer - Electronics/Product Engineer) (233411)
The Long Term Skill Shortage List (LTSSL) states in order to claim these bonus points you must have a Bachelor Degree (Level 7) qualification majoring in electronics, computer science or telecommunications AND three years of work experience with at least 12 months relevant work experience in the past 18 months
You do not appear to hold a Bachelor Degree (Level 7) qualification majoring in electronics, computer science or telecommunications
For these reasons I cannot award you with the 10 bonus points claimed for work experience.
Your points entitlement has been assessed as follows:
30 points for your age
50 points for your qualification
This is a total of 80 points. The minimum number of points required for acceptance into the Pool is 100.
Should your circumstances change in the future you may re-lodge an Expression of Interest. I must stress the importance of making an accurate points claim.
Please note also, if you obtain an offer of skilled employment in New Zealand that meets the requirements of our policy, this would entitle you to a further 50 points. If the offer of employment is based outside the Auckland region you will also receive an additional 10 bonus points. This would almost certainly provide you sufficient points to be selected from the Pool and it is likely that you would be invited to apply for residence in New Zealand.
If you have any comments or further information you would like considered in your Expression of Interest, please provide them in writing within 10 working days of the above date. If we do not receive any communication from you within the above specified time frame we will assume you have nothing further to add.
